Public Offer

An agreement for the provision of services of the Highground service (the highground.cc website).

1. General provisions

1.1. ООО «Хайграунд Девелопмент», INN 7700000000, OGRN 1237700000000 (the "Contractor"), offers any legally capable person (the "User") to enter into an agreement on the terms below. This is a public offer under Article 437(2) of the Civil Code of the Russian Federation.

1.2. Acceptance of the offer (Article 438 of the Civil Code of the Russian Federation) is signing in to the website through Steam for the free features, or payment for the paid ones. From the moment of acceptance the agreement is deemed concluded in writing.

1.3. Highground is an independent service. It is not affiliated with Valve Corporation and is not endorsed by it. Dota 2 and Steam are trademarks of Valve Corporation.

1.4. The Personal Data Processing Policy and the pricing page are an integral part of the offer.

2. What we do

2.1. The Contractor provides access to a Dota 2 match analysis service:

• Match review is a text report on the User's play in one match, with key moments and advice. It is prepared by an automatic analyzer and a language model.
• Coach chat is a language model's answers to questions about a review.
• Moments is a list of the key episodes of a match without the coach's text.
• Statistics, progress, top players, player card and other features of the website.

2.2. A review is built from the match replay provided by Valve. Valve stores replays for about 90 days, so older matches cannot be reviewed. If the replay is not available, the service does not take the match into work and does not charge for it.

2.3. Reviews and coach answers are recommendations. They are written by a program and may contain inaccuracies. The Contractor does not promise a rating increase, wins or any other in-game result.

3. Pricing

3.1. Current prices and limits are on the pricing page. As of the date of this edition:

3.2. The Contractor may change prices. A new price does not change the cost of reviews already paid for or of the current paid period of a subscription (month or year). The Contractor gives notice of a new subscription price no later than 7 days before the charge.

3.3. The Contractor may temporarily open paid features for free, for example for the duration of testing or a promotion. It is not obliged to continue free access after that.

4. Payment

4.1. Payment is accepted in rubles by bank card or through the Faster Payments System (SBP), via partner payment service. After payment the User receives an electronic cash receipt.

4.2. For a single review, the money is first blocked (held) on the card. It is charged only when the review is ready and has passed the automatic quality check. If the review fails, the hold is released.

4.3. The subscription renews automatically if, at the time of payment, the User separately agreed to automatic payments: the monthly subscription every 30 days, the annual subscription once a year at the annual price. The Contractor sends a reminder 3 days before the charge. Auto-renewal can be turned off in the profile at any time. The subscription remains in effect until the end of the paid period.

4.3.1. The trial week of the subscription costs 19 ₽ and gives, for 7 days, 3 reviews, 10 messages to the coach and moments for every ranked match; the trial week of the voice subscription also gives up to 15 spoken answers and voice questions in the overlay. It can be taken once per account and per bank card. By signing up for the trial week, the User agrees to automatic payments: on the last day of the week, the price of a month of the chosen subscription (590 ₽, or 890 ₽ for the voice subscription) is charged to the same card, after which the subscription renews under clause 4.3. If auto-renewal is turned off before the end of the week, no charge is made. A repeat trial week does not start with a card that has already been used, and 19 ₽ is refunded.

4.3.2. Turning off auto-renewal in the profile is also a refusal to use the saved card for recurring payments: the link to the card is deleted immediately.

4.4. Unused subscription reviews carry over to the next month, but no more than 8, while the subscription is active. When the subscription ends, they expire. In the annual subscription, reviews are also credited once a month, 8 at a time, and carry over under the same rules.

5. Delivery of a review

5.1. A review is considered provided when it has appeared in the User's account. This usually takes a few minutes, longer if the queue is large, but no more than 24 hours.

5.2. If a review contains an obvious error, the User may write to support within 14 days. An obvious error is the wrong hero or match, empty or truncated text, or facts that contradict the match data. The Contractor will redo the review free of charge or refund the money, as the User chooses. Disagreement with the coach's advice is not in itself an error.

6. Refunds

6.1. Until a review is ready, the User may cancel the order, and the money is refunded in full.

6.2. Once a review has been delivered, the service for it has been rendered. Money for it is refunded only in the case under clause 5.2.

6.3. The User may cancel the subscription at any time (Article 32 of the Law "On Protection of Consumer Rights", Article 782 of the Civil Code of the Russian Federation). In that case the Contractor refunds the payment for the current month minus the reviews received in that month, at 59 ₽ for each. If the annual subscription is cancelled, the payment for the year is refunded minus the reviews received since the start of the paid year, at 59 ₽ for each.

6.4. Money is refunded by the same method by which it was paid, within 10 days after the request to support@highground.cc (Article 31 of the Law "On Protection of Consumer Rights").

7. Gifts and the referral program

7.1. The User may pay for a review or a month of subscription as a gift. They receive a link that is valid for 365 days. A gifted review must be used within 90 days after it is claimed. Until the gift is claimed, the buyer can get a full refund.

7.2. Through a friend's referral link, the new User and the inviter each receive one free review. The bonus is credited once, after checking that the new account has a genuine match history. Bonuses cannot be exchanged for money.

7.3. Content creators receive 20% of the payments of the Users they brought, for 6 months, under a separate agreement. Payment is made only against a "Moy Nalog" receipt or an invoice from a sole proprietor (IP).

8. Rules for the User

The User must not:

• sign in through someone else's Steam account;
• create accounts for the sake of referral bonuses;
• automatically collect website data, bypass limits or overload the service with requests;
• use the coach chat for tasks unrelated to the game.

For violations the Contractor may restrict access or block the account. Paid and unused reviews are then refunded in money, except bonus ones.

9. Liability

9.1. The Contractor is not responsible for the operation of Steam, Dota 2, OpenDota and other external services, including the unavailability of replays.

9.2. The website does not interfere with the operation of the game. The Highground Live overlay reads only the data of the official Game State Integration from Valve and does not read the game's memory.

9.3. The Contractor's liability to the User is limited to the amount the User paid for the disputed service, unless the law requires otherwise.

9.4. The rights to the website, its design and programs belong to the Contractor. The User may freely publish and share their own reviews.

10. Disputes, changes, details

10.1. Claims are sent to support@highground.cc. The Contractor responds within 10 days. If agreement cannot be reached, the dispute is resolved by a court under the legislation of the Russian Federation. A consumer may file a claim at their place of residence.

10.2. The Contractor may amend the offer by publishing a new edition on this page. For services already paid for, the edition in effect on the date of payment applies.
